kindly guide whether criminal complaint is maitainable

as per agreement between two parties any dispute arises shall be refered to arbitration. and jurisdiction will be of Mumbai Courts

how ever one of the party has filed a criminal complaint at Nanded under section of cheating ,fruad of IPC.
