Roof right of a four floor building

If all the owner of four floors building having 1/4 ownership without roof right, can builder sell roof right to a new fifth person . The common right of land parking lift passes have alredy been given to all the four owners without roof right.

He cant sale the roof,The roof is common for four owner have right by undivided share

The builder intensionally registered all the four floors without roof right and without undivided share in roof.

How to proceed against registry of roof ?

IF the builder do then you all can file a case against the builder and the buyer
