Gazetted holidays

Dear sir/madam,

I'm a staff nurse employed in Government medical college. Before I ask a question, i want to stat something as following:

a) In our hospital A class officers like administrative officers and consultants(doctors) are getting Sunday (day off), saturday half day, plus gazetted holidays in addition summer vacations of 30 days and winter vacations of 15 day according to rules and regulations.

b) Clerical staffs including 3rd grade, 2nd grade and first grade are getting Saturday-Sunday offs (8 to 9 offs per month) plus all the gazetted holidays.

c) Nurses are getting 8 day offs per months and no gazetted holidays.

My question is it legally correct on employer's part to not providing us gazetted holidays.

Two years back our union called for a strike demanding to resolve the staff shortage and various other demands like provision of gazetted holidays. As a result with in three months 300 nurses were recruited and also gazetted holidays were provided to us.

now the administration has withdrew all the gazetted holidays only for the nurses claiming that there is shortage of the nurses. our association had submitted its protest through a letter and other remedial measures would be exercised.

Here my second question is what are the laws that support our demand of getting gazetted holidays even we work in shift duties and it's impossible to provide all the employees GH on same day. are we eligible to get remuneration for this or extra day offs on account of gazetted holidays. please reply.

What is the opinion and stand taken by your union this time?, what are their strategies to deal with the present issue?, Nurses come under essential services hence hey are to be present all through the holidays too to meet exigencies, no doubt they are to be suitably compensated for the service rendered during government holidays as being done in other establishments.  this is not an individual issue hence a collective action only will invoke response from the management/administrative authorities.

essential service employees can be denied even medical leave if the necessity so demands.

We are not demanding GH on same day. It may be provided on any day as we work round the clock shift duties. We don,t get offs on sunday or saturday but on either day according to the requrinment and that,s ok with us. My question is are we not eligible for GHs as other employees of menisterial departments (regular employees) we get 8 monthly offs on account of 5 day week perheps.
