No there is no such procedure in CPC for giving false evidence.  If witness gives false evidence, than aggrieved party will hve to make application to concern court u/s 340 of CRPC for refering matter to Magistrate for trial u/s 193 of IPC

Is there any provision to seek any respite to defendent, at least?


"Availing respite to oneself" is much more soothing for any defendent, and really worth it, than watching the "plaintiff getting repremanded" for 'unclean hands'

 

But it shud happen quickly,........................ and not as a delayed 'token of vindication' by the text of final judgement....................... and after going thru the whole ordeal.


Please answer the second part of my query also.

If suit gets dismissed summarily, then the defendent is supposed to have has won the justice 

 

bcos

a. defendent getting a breather and being relieved from whole harrassement owing to the whole litigation itself
b. which is of much more worth than getting any costs awarded for damages.
