Hello Sir,
I stay in building with 39 members. Builder has done Apartment Condominium deed of declaration. He has done deed of apartment with 14 members out of 39 members. Now after 2 years, we all members have decided to convert this into Society which we fill comfortable. All 39 members have given consent to form Society. Now we need to cancel/recitify deed of apartment for those 14 members so that they can join us in Society formation. Now builder says if we cancel deed of apartment, stamp duty will be applied which will be a costly affair.
Can you please give us a legal opinion of what exact process/cost to cancel/rectify deed of apartment for 14 members so that they can join us in Society formation?
