Constructivr possision(enchroachment)o39 r 1&2

O 39 R 1 & 2

I M for Plaintiff who has constructive possion over a land(suit property) of 3000 sq ft vide registerd sale deed of 1996

defended enchroaced over a portion of suit property and constructed 5 stories building and started to create a third party intreast in it (registerd sale dee dated 2007)

Plaintiff filed a suit for Removal of enchroachment and Permanent injunction

Now matter is for hearing of Ext 5 i.e T.I Application

Whether any application is filed for appointment of court commissioner.  In such cases it is better to get appoint the court commissioner to make the measurement, otherwise only on the basis of the documents you cannot convincie the court about the encroachment.
