Consent of most affected party.

Friends need your input. This is regarding whether while sanctioning the plan of any projects specially a project with township of high rise 23 floors building in residential zone corporation needs to take the consent of the immediate neighbour / the most affected party. I was always of the view that corporation needs to take the consent of the neighboring land holders while sanctioning the plan of any projects specially a project with township of high rise 23 floors building in residential zone. And in some cases the consent of the most affected party needs to be taken. But today an argument was raised by the corporation authority as to which provision of law / section makes it mandatory to secure such consent. In fact they are of the opinion that it is not even the basics in their list. I request you to please share your legal views and citations if any in relation to this consent issue.

It depende up on many fact like

1) Type of land

2) Town planning sanction

3) Non agriculture permission from the collector

4) If tribal land then require permission from the commissioner.

5) If slum area then special provision it depende up on the state.
