Compensation : delay in construction of villa

1 . Purchased one villa ( Land + construction) from Ansal Buildwell  Ltd at Ansal Basera Estate,Jhansi.

2. As  Ansal developed the colony in collobration with land owner (Basera Builder), registry of vacant plot was done by the land owner (Basera Builder) after paying complete price of plot.

3 A Construction Agreement was signed between me and Ansal  Buildwell  Ltd in April 2009.

4 I did the complete down payment for construction. (Rs 15.17 Lakh)

5. Possession was promised not later than 24 months from sale deed date.

6. The delay in completion penalty payment as per agreement is Rs 7000 per month after 24 months of sale deed. Whereas any delay on my part in payment to Ansal will attract minimum 24% intrest per annum on amount outstanding.

7. The construction is still not complete and it will probably take 1 more year.

 

My query is : As per  the agreement the builder will charge minimum 24% intrest per annum on delay payment but give only Rs 7000 per month for late completion of construction, It seems that the conditions given in agreement are in favour of builder. I wish to go to consumer court for compensation. I should file for 18% per annum on my amount or Rs 7000 per month .
