Compensation

Dear Sir ,

One of my friends had taken my car  , mitsubishi lancer , for personal use .

He met with an accident and the car was badly damaged .

We put up for insurance claim but the claim was rejected as his driving licence had expired by 9 days on the date of the accident .

We had asked him to either pay the cost of the vehicle or Get it repaired from an authorised service station.

He got it somehow repaired from a local garage , which we did not accept . We have asked for the cost of the vehicle which is about 4.5 L ..but he is offering us just 2L  ..saying that this is the market value of the vehicle now .

Both the things are not acceptable to me .

In this proocess lot of time about 2 yrs have passed .

Please advise me what can be done in this matter .

I think you should accept the money because legally your position is not sound.

Cant we take any legal action or make any police comp[laint against him .

Get the vehicle valued by the expert and settle the dispute. If he is not ready to pay the amount fixed by the expert then you may file suit for damages; i.e. amount fixed by the expert.
