Company not paying salary

Hi All,

I just joined a company on 26th June 2013, in chandigarh named Tech Yogi support based in Mohali as Technical support Executive, i was working there very well for almost 28 days, then suddenly on 23rd july, the general manager called me for a meeting and told me that we have overstaffing and also we are changing our office location, so you can resign right now and once we start hiring once again, we will call you up.I asked him if he can give me unpaid leaves, he denied. 

Now yesterday when i called him to give my salary for 28 days, he started ignoring and said it will take 45 days. I explained him i have other responsibilities also, and you have asked me to leave on such a short notice, how will I manage but he hung up. 

Now, when I tried today he never picked up the call nor even answered my text. I hope there are some bad intentions in that. Please help what should I do and to whom to escalate. Should I go to Labour inspector or consumer court. I just have an offer letter sent on my mail that has my joing date and the salary amount.

Have you resigned if yes have you resigned with immediate effect?

Or by tendering some notice of resignation?

 

Are you under probation? What is the notice of resignation stated in offer letter?

 

Company would be happy to square off your dues by adjusting notice pay in FNF settlement.

Thanks for the reply Kumar, however it was a very small company with almost 12 employees, and on 22nd July the general manager called me and informed that we have an oversraffing issues with my dept. So you can consider your resignation from today n once we have some better conditions we will inform you and you can join back. So. It is never a formal resignation.
