Company is not giving my salary

Dear Sir,

I worked in Daana Software Developers from 01-May-2014 to 27-Oct-2014 as a Senior Graphic Designer at New Delhi. On 27th Oct, 2014 company MD told me that you don’t how to work and he fired me without any notice and his not giving my 2 month salary. There is no revert from the company of my phone msg. Etc.

 

please help me out

Were you fired in writing?

Did you submit any written communication so far that you were verbally terminated on dated............by Mr/Ms..............in office and no termination order in writing, FnF statement, payment of FnF wages, service certificate, relieving letter, PF number with a/c slips,Form16 as per correct FnF statement, salary slips of all months,ESIC card, NOC/NDC etc has not been supplied to you till date?

Have you recorded the telephonic conversations?

Was any appointment letter/offer letter issued to you?

This company is not doing paper work, I have only text msgs, cheque statement and company salary account.

The office of the company in which you were located and Redg. of the company is located in which state?

This company is not doing paper work like joining letter, reliving letter, salary silp etc.

Such companies are covered by ( name of the state) Shops and Commercial Establishments Act .

This company apparently has violated the provision of Delhi  Shops and Commercial Establishments Act, Delhi Shops and Commercial Establishments Rules, Payment of Wages Act by not issuing the appointment letter, salary slips,termination order..............and it is one of the duties of the Inspector appointed under these Act to ensure wages,FnF dues and all other docs are supplied to the employee in time........

 

You may approach Employees/IT-ITeS employees unions/Trade unions/Labor Law Consultant/Service matters lawyer with all docs on record and proceed further under their expert advise.....
