Common passage usage

We are planning to purchase a property whihc has a common passage where Water connection,EB, telephone lines are available. and this passage is used by the family member who have property on the same line, One of the property owner in that ane who also use this common passgae now claims that the passage is not common and the common passage land is in my Name.

But this is the way whihc is used for 3-4 owners for almost 30-40 years..

Seller agreed to get a court order that this is the commonpassage for the property whihc are planning to buy,

In this situation can we purchase the property if court say that this is the commpon passage? will the above said person who claims the passage is in his Name(with patta) can he or his son's/daughters or his family members create any issue?

Please suggest and advice

If the court said it is a common passage, every successor has to abide and obey the court orders unless other party go to appeal for higher courts.
