Commercial rental agreement

Hi Everyone,

I am Raju from Hyderabad. My father (late) used to run bakery business in hyderabad for more than 50 years and now coutinued by my family.

Building is more than 70 years old as it has reached its final stages.

LANDLORD's family is very big and they dont stay in Andhra Pradesh. Due to this reasons, we are not sure about the owners contact numbers, in case of emergency.

However, someone from the family comes once in an year or 2 years and collects rent.

Recently, during raining season, we had a problem with roof TILES. Hence, replaced it with asbestor sheets. Now, one of the owner's family member claim that we have changed roof tiles to asbestor without his permission.

For this reason, he wants us to pay a penality of 30 thousand.

Second, as this shop is our livelyhood, we would like to purchase it at market price (7 lakhs).

But, he is not willing to sell any amount below 25 lakhs.

Are these two conditions correct as per govt laws.

Firstly, you talk only to the title holder and not  to any one who claims to be the owner.  If you want to purchase the property, you can do it but you cannot dictate terms on the purchase price, reasonable flexibility has to be applied while sitting on negotiable table for purchase. Permission to alter the structure to be obtained from the owner.

First, thank you Kalaiselvan for your valuable time.

Yes, I do accept that I am not the right person to decide on rate as its land owners property.

But, is it correct to ask four times the market rate. When market price is 25 thousand per sq.yard. Owner is requesting for 1.08 lakhs per sq. yard.

Is this correct as per govt norms.

We as tenant dont want to loose it as our life run over it. But, at the same time, we are not so rich that we would be able to give him 1.08 lakhs for each sq.yard.

This is our problem.

Can this be handled by law. We have rental agreeement since 1974.

Also, I request other friends to share their knowledge in helping me.
