I have Purchased my Flat on 23rd May 2012(Registration), and got possession on 9th June 2012.
I paid all the society transfer fees(withdrawn by society) and Society gave me an NOC as well.
After a year I plan to transfer my home loan to SBI, I requested for a NOC for which I got a reply from society that you need
provide Foreclosure letter and a letter from SBI to process the request further. I then transferred my loan to SBI based on the letter provided by Society
I closed my loan account with there bank and provided foreclosure letter and a letter from SBI demanding for NOC.
After following up with the society for a month they convey me that they cannot issue a NOC to me as the said flat is under sub-judiciary.
On knowing it further I ame to know that the neighbor was purchasing the flat from my owner and due so or the other reason she didn't sell the flat to him.
and he has filled a Suit against her and society,
Also they have an AGM on 11th August and they have not sent me agenda of the meeting on asking about it they said you are not yet a member of the society.
Now My questions are :
1) I have given an application for flat transfer on 9th June 2012 and since then I didn't receive any written communication that there is a suite about filed and flat cannot be transferred until then
is it legitimate on societies front not to send me Agenda and not considering me as a member as I have paid all the maintenance and major repair bills for past one year.
2) I am in a soup in terms of NOC for required for Loan , as bank is calling me and asking for NOC , as they need to complete the Mortgage formality.
Shouldn't society should give me a NOC ?
Please help me with the above query so that I can get what I deserve and have rights to get.
