Child costody

Wife filed 498a and 125 case and kids are with her at 200 kms from pune. But she is not staying with them. i want to take kids with me but on the jurisdiction basis family court are not ready to get register my case and side i known that i can file under 97 crpc for child costody is it ok. please suggest me what to do for further action.
