Cheque bounce

Sir

We had recieved a cheque from a customer for a full and final payment of his account. which was dishonoured and we had summoned him for the same last year.He had played smartly and did not recieve the notice's and passed on the time.

He has not deposited another cheque in our account which also has been dishonoured without our notice.

Can we summon him for this fresh cheque as well.?

I apologise for my clerical mistake. It was deposited and bounced again...So can a seperate case be started for the fresh cheque issued and bounced.?

Dear Ankit,

As per queries, you have got two cheques, which were bounced on two different dates but liability is same. The legal position is you can persue only one case. but for putting pressure you can file two 138 NIAct cases.
 when he will appear in either you will get the relief. for settlement you can ask for compensation as well as litigation amount along with cheque amount.
