Our society has 6 buildings with 16 flats in each buildings. One of the building members have formed a FSI committee and constructed and utilized additional FSI granted by municipal authorities (NMMC). The construction is complete 6 months back but they are not getting OC for the additional FSI from NMMC because of new CRZ norms and it seems they are not going to get it in the near future.
Now the society wants to increase the maintenance charges of this particular building on Repair fund, sinking fund and insurance, but the members of this building are protesting and opposing the move because the additional constructed area is not registered yet although they are enjoying the benefits of additional area.
What is the option with the society? Should he society charge the building with additional FSI, at par with other buildings with less area or increase the charges as per bye laws? Please note that the additional area constructed is not completedy illegal as they got NOC from NMMC but no OC after completion.
