Car parking

dear sir

i purchased a flat of 850 sq.feet with undivided share of 568 sq. feet. At that time others accepted that only 3 flat owners are having car parking places. Out of 3, one flat was retained by the builder which he let out for rent.

a llat owner purchased a car and parked it in my area. I didnot raise any objection for that, since i didnot own a car. Now the same flat owner purchased 2 mini lorries which are used for commercial purpose and also he took a next house for lease. Now he parked his car in that leased house and kept that one commercial vehicle in car parking area in our residece.

i objected to park that commercial vehicle in the car parking area. That owner also used his flat for commercial purpose by keeping 1 or 2 deep freezers in his flat and doing the (freezed ice) sale also. In our flats(9flats), my self and other flat owner objected to park the commercial vehicle.

That flat may be 650 sq.feet constructed area with 400  sq. feet (approx) undivided share.

my questions are 1. is the parking of commercial vehicle is allowable? 2. Since my flat is biggest flat than others, shall i have priority for car parking. ( Now the other owners are denying what they had old eralier reg. car parking) 3. The builder told me that he is having car parking (his flat is 715 sq. feet), since he paid himself for car parking during construction and that was mentioned in his documet.

That flats are 12 to 13 years old. In my document there was no provision reg. car parking.
