Can i make stop payment ?

I owe X amount of money to the seller of my flat.
This money is apart from the agreement value of the flat.
I have given to him in writing on a stamp paper that i will pay the X amount of money after the share certificate of the flat is transferred on my name. The purpose of holding back the money is not stated neither the reason why i owe him the money is stated.
However, in the interim i have sold the flat now.

I have paid him the X amount through cheque and got the original undertaking on the stamp paper back.

1) Can i make a stop payment of the cheque ?
2) Will NI act be applicable to me ?
3) Will he be able to prove me guilty only on the basis of the Photo copy of the undertaking ?
4) If at all, i have to fight in the court, what options do i have to defend myself ?
5) If at all, I have to fight in the court, how much time does the case go on ?
