Can Phone records/SMS be used as a evidence in the ground of adultery in divorce case?
My wife has filed for divorce, case is going on. I have filed for RCR.She has filed for divorce on grounds of domestic violence and that she is harassed by my suspicious nature. I have come to know that she may be having an affair with one of her friends, whom she has met after she has filed for divorce.Can i apply to the court to get call records of their phone numbers to prove that they are having an affair?Will I be able to get the details of the SMS or call conversation. I also realized that the number she is using is not in her name. Will I still be able to prove adultery?
