I purchased a flat in 2009 in Aurangabad (M.S.). The builder's plan showed lift as well as ample parking space. The same has also been mentioned in the registry document. The flat is 1200 Sq. ft, super built up.
However, as on date, neither the lift has been installed nor the parking space provided. The lift duct is being used by the buider and his tenants for dumping household garbage and the parking space has been made into shops and rented to business people. He also has not done plaster to the building from outside and this creates problem in every monsoon when the water seeps into my flat. There is no common water tank provided, neither a society registered. He has not made any shade at the end of the staircases leading up to the terrace and so the rain water drips on the staris like a waterfall.
I would like to know whether an action can be taken in consumer court on this ground and how likely the matter is going to be resolved in my favour?
