Builder cheating

I had booked a duplex in 2008 with initial payment of 30%. In Early 2010, the project design was changed and I was assigned a new flat at original price though many others withdrew from projects due to change in design. The delivery date of new project was May 2012. Now since last few months, builder has launched another new project at same location under new name and there is no intimation to us existing customer on remaining payment or new allocation. When we discussed to them, their answer is to pay the current price, which we don't agree to as our view is that we have been with them since 2008 and had agreed on initial project based on market rate only.

We have original allocation letter and agreement letter for second project.

What kind of actions can be taken against the builder. Pls advise.

File a complaint in the consumer forum.
