Builder changed floor plan for the one appended with Registered Agreement?

We are tenants protected under Maharashtra Rent Control Act and have a registered agreement for permanent alternative accommodation in the Redeveloped building.

To our shock builder has unilaterally changed the location as well as floor plan from 1BHK to 1RK. Which not acceptable to us. Not only this he has provided toilet in the kitchen area which is another ugly act.

We had asked him to provide final approved plan by filing Contempt Petition but he dis obeyed even Bombay High Court.

Is it criminal offense?

What legal steps we should take in the matter as we can't accept this fraud. TIA

If the builder is deviating the approved plan as per his own terms or desires, you can approach court with a suit for permenat injunction to restrain the builder from proceeding with his construction plans and for further reliefs as per provisions of law.

Since the builder does not seems to be a law abiding citizen as well as he is not cooperating to complete the construction as per approved plans, you may even seek for termination of agreement and stop him from carrying out further construction and to seek court permission to utilise the deposit amount for construction as a penalty to the breach of agreement
