Unless the agreement is written and registered such agreements are difficult to establish in a court of law, and it takes several decades to fight out in court, even if you can bring such witness.  The law states that all legal heirs are entitled to equal shares and you can not deny his share in the property.   Convince him through friends and relatives and try to settle the issue by giving him nominal amount and get such settlement deed duly registered.
