I have 14 cent plot, all the 3 side have boundary wall. One side has another plot where there was no boundary wall just barbed fence. Recently my neighbor approached us to construct stone boundary wall and fence since they have started construction in their site. We agreed to a cooperative and construct the boundary wall. We agreed that one of us will built the foundation stone wall and share the cost equally and then the other person will build the wall on top and again both parties will share the cost equally. I was asked to create the bottom stone wall, they had specification to raise the wall 1 m high since they will be filling the land to 1m high and also to make it strong that they will building a strong wall on top of the stone wall. So I got teh workers and constructed a strong wall with 1m high above ground level. While the work was going on my neighbor was also there giving instructions how they want the wall. Once the construction was over, I informed the amount adn asked for the settlement. Then he said now they will build the wall on top and they will bear the cost of the wall that they are creating and asked us to bear the full cost of the stone wall.
The cost of creating the stone wall is more than creating the wall using bricks on top of it. What should I do if tey refuse to pay me half the price of the stone wall?
For me, I m not in any urgent need to build a wall on top of this stone wall. Also if they had told this earlier I wouldnt have raised the height of the stone wall 1 m since I am not filling up my land.
Is there any legal solution to this? Can I get an injuction from court for further construction?
