Booking amunt refund

I have booking a flat in pune 14/2/2015. with mou notary Where mention that whin 1 year possion get by me. i have paid booking amount thow cheque.after 3 month builder tel me you can give me 1 lakh rupees then i will give you a flat possion in 3 month. Then i have give 1 lakh thow cheque.Then i am ask for passession. He will not get passession that time. Then builder and witness Rajesh yadav meet me the hotel where witness write on paper "aap ko 7th nov 2015 ko aapko flat ka possession mil jayga"where sign on builder and rajesh yadav witness.builder not give me possession that time.Then i have ask my booking amount. Builder told me am not able to refund your money. After 4 month i will pay your booking money get cancalation deed on 01/01/2016.give me post dated cheque On 21/04/2016.Then 21/04/2016 i had deposit cheque my account and i have send the massage to the builder."I have deposit the chque my account pls dont bounce cheque". After builder massage me deposjt on 29 apr 2016.both time cheque was bounce back. After i had call to builder then he was say cheque deposit on 19/05/2016.That time also cheque bounce. After i have send the legal notice thorw my advocate no any reply from builder. After i have write complent to the police station againt builder.police call to builder and ask him matter.builder told me cheque deposit on 05/07/16.That time also cheque bounce.Then i have go to the consumer court. i have submit all the related document to the court. I have late submit (date.22/11/16)the mobile massage details( from builder) and affidabite by witness rajesh yadav.Then Consumer court refuse my 2 proof massage details proof and why late submit the affidabite by rajesh yadav.both proof are rejected. Then what kind of proof i am submit the consumer court for my booking amount refund and my losses recover.Please kindly Help me.
