Your brother has to apply for the birth certificate to the muncipality ( Registrar of births and deaths) then they will issue non availability certificate, after that he will have to file criminal miscellenous case in the court to get direction to enter date of birth in the registar of birth and deaths.

If your younger brother is not completed X class, if he illeterate or semi illeterate, simply ANNEXURE A affidavit have to submit to the passport office in place of birth certificate.
