Insurance company IFFCO-Tokio has refused to provide the claim for total loss vehicle after conducting the survey on account of delay in intimation. And now my vehicle is lying toyota kundli for past 8 months and I have to pay 60,000/- to recover my vehicle. They issued a legal notice to me for auctioning of the vehicle in June'16 whereas the vehicle was lying there since Feb'16. They also said that parking charges well exceeded the cost of the vehicle. In such case do they have the authority to recover the remaining charges from me. Till now they haven't auctioned my vehicle. My vehicle details are Toyota GD liva, Year- Jan'15. When they served me the notice at that time parking charges were around 35,000/-. What legal course of action they can take against me. Please help, I haven't have the money to pay the charges. I am also paying EMI of 10k p.m. for the vehicle. Please help.
