application by repondent U/s 242(3) and 311 of crpc in cases of maintenance to find out truth by summoning up and cross examining witnesses produced by applicant is maintainable and sustenable? I am respondent and I have brought some truth before court.But the lawyer of applicant argues that this appliction is not maintainable as these sections are ment only for prosecution cases.

As far as 242(3) is concerned this choice is only with prosecution but under 311 you may appy.

Cases registered under criminal sections shall attract criminal sections then why section 242(3) shall not be applicable.
