Ancestral property partition !

19 June 2012

Dear Sirs,

May I would like to inform the below details to help us in getting a good reply from you all.  My father-in-law's Mother brought a Property for her and she wrote a will that His son (My Father-in-law) has the right to enjoy the property and after his death all the 04 Grandsons can partition the Property in equal Share.  The Fourth Grandson is my Husband.  We belongs to Hindu Family.

All the other 03 Sons of my Father-in-law was not with us where as myself and my husband was taken cared our In-laws.  Atleast 03 Years back our Father-in-law wrote a Will for all his four sons with equal share and a share to his wife after that his wife's death the property should be given to his fourth Son ie., my husband.  May I request you all to answer that this is possible and shall we get the property as my Father-in-laws Will or there will be any problem we get if the other 03 sons file a suit against us.

Also please explain How the property is divided and partioned to all of us ie., 04 of us.  Who will get the share in front Side ? who will get the share in Back Portion and who will get the partion in between.  Is there is any rule or law to partion like this or can we take the partioned portion as per my Father-in-laws will.

Kindly clarify ?  My Advance thanks to people and  person who gives me the right solution to all my questions.

Thanks & Best Regards

KKV

The property  will have now  4  share only   as  reflected  in  first  Will  of  its  purchaser  i.e  Mother  of  your  Father-in-law.  The  property  can  be  distributed  through  making  "Partition  Deed'   by  all the  4  share  holder  by  mutual  consent  and  consideration  in  a  family.  Anyone  among  the  4  share  can  "Relinquish"  his  share  in favour  of  anyone among 4 , if he does not want  his share.  The member who will receive  the relinquish share will become the  2/4  share owner  of   total  property.  "Partition Deed"  & "Relinquishment Deed"  can be made  at  Registrar Office for  the purpose of   trasferring the ownership  by all the 4 members.  If any member does not co-operate  than  a legal notice from an advocate to him  can be sent  and  a suit for partition  making all the 4 members  as  parties  can be filed.
