Ancestral property

Sir,

 

  My maternal parents specifically my grandmother was having tenancy right in the property.During the death of my grand mother  myself and my fatherI used to stay with her.this is an ancestral property .My grandmother(gm)had 2 sons and 2daughters,of which 2daughters post the marriage had left the house and 1son was seperated post his marriage.

Eventually elderson i.e my father and myself were staying with my gm in that ancestral (tenancy)property.In the year 1985 my grandmother expired.post that my father and myself used to stay in that house .susequently in the year 1997 JUNe i got married and myfather continued to live in that house.thereafter in August 1997 he expired.there after property was locked. then in 1999 my family ie my husband, my kid and myself stayed there for 2 yerars ie upto 2001.

however from 2005 my aunty(elder daughter of my grandmother) started staying ther with her family ie husband,2 sons and 1 married daughter and her son.(due to her poor health and financial distress.)

In the year 2011 my aunty expired and currently the house is occupied by her 2sons and a daughter and her son.

considering the aforesaid factual background as regards the tenancy rights would require your response on following :

 

1)  whether the landlord can compell vacation of the house since no legal decendants are alive or staying in that house.

2)  Whether this tenancy rights can be transfered?if yes in whose name? 

3)whether the person entitle for tenancy right has power to issue NOC to land lord for getting this transferred in the name of relatives currently occupying the house?

who is paying the rent to the landlord and how????

The rent receipt is issued by the landlord???? if yes, then in whose name????

where are you and your husband residing at????

is your landlord aware that the persons residing are not the actual tenant. but the relatives of the tenant?????
