Sanjay Balkrishna Ganave (Secretary)     24 October 2013

Accepting new members and conveyance

I am a member resident of already registered society. The society is established in the year 2006. Now builder has constructed new building in the same complex. Our building is registered and say constructed by "A" Builder and new building is constructed by "B" builder having different power of attorny. Now builder is insisting for gettting members admitted from new building to already registered soceity.

1) Whether these members can be admitted to already registerd society since building is constructed by another builder having different power of attorny.

2)Whether once single conveyance can be made.

3)what will be legal implication in above scenerio.

4)VAT and Service Tax is applicable for newly constructed building however it is not applicable for our old soceity memebrs .

5)What precautions needs to be taken because builder is adament and society secretary and chairman are in their favour. They do not now ABC of Maharashtra Flat Ownership ACT and Byelaw of soceiety.  They are just listening of builder and not other committee members.

please advice.

The registrar of societies of Maharastra will have guide lines. That every builder has to follow.
