About property

1.My dad has expired 3Yrs ago and left no will.His plot in paithan Dist Aurangabad (Maharashtra) need to be transferred to legal heirs.What is the procedure for transferring property on my mother's name.pls help? Any Registration fees or Stamp duty needed to paid? 2.In case registry fees are applicable, then if the legal heirs chooses to transfer the house directly to the children of the legal heirs, will it save the registration fees for their children.

It seems to be a simple case of inheritance.

It should have no fee.

ClassI legal heirs of Hindu male are; Mother, wife, sons,daughters.

Obtain mutation record with link documents from concerned revenue official say; Patwaari, and all link documents.

Obtain legal heir certificate/affidavit from Tehisldar………………..

Submit copy death certificate, legal heir certificate/affidavit to concerned revenue official to record inheritance.

All legal heirs can dispose their share in favor of anyone say; Mother ( your mother) by a valid and registered deed say; gift/sale/relinquishment/release…………….

The fee for deed amongst blood relation in your state may be negligible.
