did he write a will on your mothers name or did he die intestate

Sir,
There is no will, he died intestate.

then with the death certificate obtain a legal heir certificate from the tahsildars office by filing an application for the same.then you can mutate the property over the legal heirs.if you brothers wanted to relinguish your share you can do so by making a registered relinguishment deed
