SCI- THE GREATEST CONSTITUTIONAL BODY, HAS FINALLY & JUSTLY RESPONDED TO THE SOS CALL OF THE 49 MONTHS UNPAID PAYROLL EMPLOYEES OF TYRE CORPORATION OF INDIA, KOLKATA WITH A VERY POSITIVE ACTION TO PROTECT THE VERY FUNDAMENTAL RIGHTS  .

It is a great honour to the 49 months unpaid innocent payroll employees in particular, struggling for survival , being duly Ravaged by its own Master, The Model Employer,GOI-DHI and the peoples of India in general THAT SCI- THE ULTIMATE CONSTITUTIONAL BODY TO PROTECT OUR CONSTITUTION & THE VERY FUNDAMENTAL RIGHTS OF THE PEOPLES OF INDIA AS CONFERRED BY OUR CONSTITUTION . ACCORDINGLY THE HONORABLE SUPREME COURT OF INDIA HAS FINALLY TOOK COGNIGENCE TO THE PLIGHT OF THE 49 MONTHS UNPAID PAYROLL EMPLOYEES ( OF 100%  GOI-DHI OWNED, CPSU, JUST THROWN IN THE STREET BY A BRAZEN, MALICIOUS, UNDEMOCRATIC  -UNCONSTITUTIONAL  WAY & TOOK SHELTER BEHIND THE ORDER OF LIQUIDATION ) BY REGISTERING A DIARY NO 14210/2017 DT 30/03/2017-

AND We the victim of Administrative Calamity in DHI-GOI & Subsequent Failure of DHI/DOD-GOI towards Disinvestment of TCIL in accordance with TCIL Disinvestment Act 2007 knocked every doors of GOI ( even Judiciary ) to resolve the issue while achieved only Despair/passive rejection during the last 49 months at that time The above response from SCI , Once again proved that the SCI is the THIRD EYE of our COUNTRY to NOT only OUR constitution but also The VERY fundamental Rights to  the citizens, even when the respective Violation occurred by the STATE –GOI_DHI itself And our humble submission is as follows

Your honour under the above circumstance we are speech less after receiving  your SMS from DZ-SCIS on 30/03/2017  through my mobile & it appeared to me that GOD has finally come to save the lives of the poor unfortunate human beings  in TCIL-Payroll, who lost their every right to live in this worlds largest Democracy.

 And your above benevolent Execution has finally showed a Torch of Light with all sorts of HOPE & restored our Confidence for Survival with respect to letter Petetion dt 18/03/2017 as furnished below. And on behalf  all the victims we once appreciate your valued action & thank you and all of your GOOD- Office for their innovative Execution & Positive Response.

Sub: Case Details of File Number-776/25/8/2015 & your valued Proceedings dt 25/01/2017 28/1/16&27/8/2015 in continuation to your valued proceedings dt25/5/2015)wrt. DHI-GOI letter dt22/07/2015 regarding Nonpayment of Salary to the Poor TCIL employees since Nov 2012-Immediate implementation of VRS to the remaining 112 Payroll employees of TCIL.

( Kind attention to Honorable Justice Cyriac Joseph &Mr Sharad Chandra Sinha )

Dear Sir,

This has the afore said references & we are aware of the fact that , the Competent Authority of TCIL,KOLKATA, ie DHI-GOI has responded along with the reports as the same was advised by the Commission(NHRC).And undersigned also simultaneously approached to the CCEA(with copy to PRESIDENT OF INDIA ). Consequently we received the acknowledgements from PMO & PI Secretariats wherein they also have categorically adviced the Secretary-DHI,GOI to take appropriate action on 10/08/2015 &20/08/2015 respectively( our petetions To CCEA & respective acknowledgements are enclosed herewith for your kind Perusal ). Unfortunately we received Only 82.6% of our Salary (NOV2012 to March 2013 , months ) while Our 49 months Salari is still unpaid including our VRS Benifit & This most unfortunate Execution of a Model Employer like DHI- GOI has not only paralysed our lives of our family members but also made aquestion mark to Our Fundamental Rights as mentioned in Justly mentioned in your last proceedings dt 25/01/2017

 Accordingly we the poor employees of a CPSU (100% owned by DHI-GOI ) are the victim of Financial Racket of disposing off the property Of TCIL having value of More than Rs 200Crores for a Throw away Price Through Official Liquidator, to the Parties who participated in the Due deligence in2011-12 towards Disinvestment . It appears that may be there is a forceful Purported Conspiracy of high handed Political Executivesas well as Bureaucratic executives which led the DHI-Authority so daring,ignoring the Human value &Rights, not to vacate the liquidation of TCIL, despite the sanction of 9.05 Crores by MOF as payment to the unsecured Creditors,that caused the liquidation. Not only that in the Order of Dismissal of Calcutta High Court, dt 7/08/2014 clearly stated –The order of dismissal would however not preclude the appellant or any other interested party to seek revival of the unit by approaching the Learned Company Judge in accordance with the Companies Act 1956-- & even after that DHI-GOI, with the Valued sanction of Rs 9.05 crores in hand remained shilently sitting idle in the pretext of Liquidation, jeopardising the lives of the poor Pay Roll employees &of their family members, leting themselves be reuined in poverty , coming out of wrong Industrial Policy & Total Breaucratic failure in the perspective of TCIL- A daring violation of our fundamental Rights- 1) Right to Livehood, 2) Right to Employment 3) Right to education of my chieldren, directly BY A MODEL EMPLOYER,The GOI-DHI.

And in the meantime Honorable Calcutta High Court Has ordered an STAY to the sale of TCIL ( Rs 200 Crores Assets) by Official Liquidator for only Rs12 to VSCommercials of New Delhi. And Official Liquidator are now in Long Que to Settle the Dues of the Payroll Employees ( Total Claim around 35 Crores as Submitted by the Employees )

 Apropos to above situation your goodself is once again requested to take appropriate steps to save our lives & to restore our above said Rights as Conferred by our Valued Constitution ( especially Article 21 & 23).

We looking forward to receive your Valued Judgemrnt that will direct the DHI-GOI to release our 36 months Salary along with our VRS/ VSS benefits & all statutory Dues immediately within a stipulated time Frame. Positively & also a CBI enquiry to be carried out to punished the corrupt officials who purportedly dragged TCIL into liquidation by Releasing the same from the Purview of BIFR(SICA) in the pretext of Revival.

Hope you will appreciate our views & will do the needful at the earliest to save our lives for the sake of Humanity as well as Democracy & to honour our Constitution( Fundamental Rights )
