Delhi hc"consumer court can decide mobile phone consumercase

It is learnt that recently Delhi HC has passed a judgment that complaints of consumers of mobile telecom companies can be lodged in consumer forums and consumer forums can decide such consumer cases. However the name of company etc is not confirmed.

This judgment is very urgently required.

Your help is sought. Kindly provide the link or details or judgment.

Dear Doab,

Supreme court Judgment that barring jurisdiction of consumer forum is not true. Usually the judgment of supreme court has misintrepreted in many such cases. It is just an ordinary decision given by Hon'ble Supreme Court in that case without any principles of law discussion.

In present Scenario, consumer forum has not following the basic prinicples of law in deciding telecom disputes, this has made avenue for  the Pvt. Telecom companies to harass and betray the common people.

It is well settled that a mere direction of the Supreme Court without laying down any principle of law is not a precedent. It is only where the Supreme  Court lays down a principle of law that it will amount  to a precedent.

Above priniciple and wordings of Supreme court has Out looked by most of the Fora.

However, There is a Exception in this also, I would like to share the order copy of DISTRICT CONSUMER DISPUTES REDRESSAL FORUM, FEROZEPUR   

In the Above Judgment, Proper justice and discussion law is made.

This judgement has been quoted by many lawyers in consumer forum. However the president has declined and rejected all cases.

We shall try on the lines suggested by you.

Kindly provide some more inputs.
