Dishonour of cheque _ Unsigned complaint.

A recent Judgment of Bombay High Court in a Division Bench Reference. in case of absence of signature of complainant in the complaint. (Reported in 2010 (6) LJSOFT (URC) 79)

Dishonour of cheque _ Complaint can be instituted in writing, however, it need not be signed by the complainant _ When such complaint is subsequently verified by the complainant and the process is issued by the Magistrate after verification, it cannot be said that the said complaint is "non-entia" _ Prosecution of such complaint is maintainable.
