Custody of child

Sir, My son was in the custody of her mother . My wife died on 2/10/18. I want to take custody of my son . I have learnt that a distant relative of my wife is substituting my wife. My wife gave an allegation of strangulation against me which has been proved false prima facie as per medical report. Under the above circumstances, what are the chances to get custody of my son and whether substitution possible in cases filed under Guardian and Wards Can Section 50 (2)of Code of Civil Procedure be referred?
