The accused (husband) cannot pray or press for a speedy trial in 498A.

10 years is not unusual for disposal of case.

If you are aquitted by the court in the 498a case by ruling out that the allegations made against you were false then that becomes a reason for claiming divorce on the grounds of cruelty. But if you want to file divorce without waiting for the 498a to be over also you can proceed as both divorce and 498a are different cases

Disposal time for 498 a can't be defined it may take 6-7 years. Accused can't apply for speedily trail. Husband can apply for divorce any time. Both cases are different and files in different courts. You should file divorce also so your 498 a and divorce case will run simultaneously. If you file divorce after disposal of 498a you have to wait for disposal of your divorce case another 4-5 year.

Rcr is better or divorce petition is best way to get quick divorce?

Sudhir Kumar, Advocate (Advocate)     29 May 2016

No need to file RCR.

RCR is filed only to provoke wife to file 498a complaint which she has already done.
