138 n i act complaint

नमस्कार मैंने SBBJ बैंक की और से कोर्ट में चेक अनादरण का परिवाद 138 एनआई एक्ट में पेश किया था, शाखा प्रबंधक को बैंक के गजट notification में परिवाद प्रस्तुत करने का अधिकार दिया गया है परिवादी शाखा प्रबंधक का स्थानान्तरण राजस्थान से बहार हो गया है, परिवाद में परिवादी से जिरह होनी है, अब प्रश्न यह है की उक्त परिवाद में क्या वर्तमान शाखा प्रबंधक का शपथ पत्र प्रस्तुत कर जिरह करवाई जा सकती है या जिस परिवादी ने परिवाद प्रस्तुत किया उनसे ही जिरह होगी ???

Rajeev, is there any direct case law for your observation. I understand under S.145 and Mandvi ruling by SC atleast the person who has filed the affidavit must come for cross if called, but MMTC case and associated cement case is being used by trial court even to allow such things, which I feel is questionable.
