Irrespective of that, you must appear in court and seek bail . The defence of the comploaint being barred due to limitation shall stand once you make an appearance and plead your defence. As such condonation is maintainable as far as delay in filing the case is concerned. So appear before the court , seek bail and then you may take the defence of the time limits as you mentioned.
