'Bifurcation of HC would be against spirit of Constitution'

 Members of the Allahabad High Court Bar Association (HCBA) on Tuesday observed `Sankalp Diwas' and resolved to protest unanimously on any move of bifurcation of Allahabad high court. 



Presiding over the meeting, HCBA president, VC Mishra while quoting the Constitution observed that bifurcation of the high court would be against the very spirit of the Constitution which envisages one high court for one state. 



He pointed out that the city played a pivotal role during the freedom struggle and even the Allahabad high court through its landmark judgments delivered from time to time has strengthened dispensation of justice. 



Secretary of HCBA, Veer Singh while decrying the move pointed out that it was more of a political gimmick aimed at garnering votes. He declared that any such move initiated by the government would be detrimental apart from becoming an impediment in dispensation of justice. 



Meanwhile, president of Bar Association of Uttar Pradesh, Vishnu Pandey called upon politicians to desist from making such statements in public which create an air of uncertainty.

 MP has three benches - Gwalior, Jabalpur and Indore.

Allahabad has two benches - Lucknow and Allahabad 

Chennai and two benches - Chennai and Madurai

Rajasthan has two benchs - Jodhpur and Jaipur (Jaipur abolished in 1958 but restarted in 1977)

Two states Maharashtra and Goa have only one High Court.

So what is the problem in having more benches of the same High Court at more than one place in the same State. High Courts are menat for the public or the public is meant for the High Court.

In fact there is no reason why Supreme Court should not have have a bench in the South. Imagine a person in Kanyakumari going all the way to Dehi for his case.

Punjab and Haryana have one High Court.

It it was the spirit, why benches of the High Courts were set up at other places in the same State. Let us not live in a cucoon.
