Marching Towards Real Democracy

As a citizen of India I expect my country to be heading towards growth and development. The growth and development doesn’t only mean growth in terms of Industrial output or raise of mega cities. As a citizen of India, I need a change in the society, a change which will take our society towards better thinking and a better future, a society which will be free from malaise like corruption, high Inflation, gender Inequality, crimes against women, where every Indian can feel the freshness of freedom, filled with the sense of security.

This feeling is not just mine, it’s the feeling of every Indian Citizen and just like me every citizen is expecting a change for their betterment of the society as a whole. This was very evident from the mandate of the legislative election results which came on 8/12/2013, where the fate of congress was written by Citizen of India and once again showing that it’s the people who are the King of Democracy not the political parties.

In many ups and downs a new party emerged from the dust and it was Aam Adami Party (AAP), which has Broom stick as an election symbol. Under the leadership of Mr. Arvind Kejriwal, it’s the AAP who pitched their voice against corruption, misuse of Public office, raising tariff of electricity in our capital city Delhi. AAP emerged as second largest party in Delhi Assembly elections and over throwing Sheela Dixit Government. Mr. Arvind Kejriwal defeated Mrs. Sheila Dixit in her own constituency by a margin of 25,864 votes.

I feel the time has come when the people from common masses should pour in into Indian Politics and new face should be given to Politics in India. The AAP is just an example for the same, which is not like any other traditional political party; it is a party of common masses, it has Doctors lawyers Security personals and above all the leader itself was an IRS officer.  

It’s time to give a new dimension to our country and every citizen of India should come forward and work for a new beginning to Rising and vibrant Democracy.

According to me the key Challenges which need to be tackled currently for marching towards Real Democracy are:

1. Corruption  in Public offices

2. High inflationary conditions

3. Misuse of public offices for personal gains

4. High incidents of Rape

5. More public accountability with respect to government employees

6. Jan lokpal bill needs to passed in parliament

7. Protecting the citizens from Internal and External Threats of Terrorism and naxalism

8. Protecting the sovereignty and integrity of India including J&K and Arunachal Pradesh

9. Taking off reservation from democracy. Providing more Facilities benefits at grass root level for upliftment of SC/ST/OBC so that they can compete at par with General Categories.

10. Making promises of reservation in election campaign and their election documents should be made void ab initio along with heavy penalty and the same should be made of the Violation of Model code of conduct during election time.

11. Strict adherence of laws by every citizen (Even the traffic signals and no payment of bribes to traffic police officers)

12. Speedy Courts for better Judgments and  non delay in justice

13. More independence to the organization like CBI without affecting dilution of control.

14. Better network of ATS and Crime Branch between states along with speedy sharing of information’s on National Importance.

15. Betterment of Panchayati Raj.

16. Better Implementation of Yojnas and government subsidies.

There are many other factors which need to be tackled but the above ones are the factors which has been arrived after a strict Pareto analysis (80%.20%) and these contributes towards 80% problems India is currently facing which needs to be addressed first.

Political parties like AAP and people like us should work on the above issues so that we can march forward toward Real Democracy and put India into the track of Growth and all round development.

People who have n't had proper education, unfortunately, who always look for next meal, do you think really think about all this. Even if 20% of voters belong to this category, well a good or bad government can come to power

The People are we in a position to dictate Political Parties to put up Intellectual of Intelligentsia as their Party candidates to contest as M.P. or M.L.A.Political parties have no prescribed Statutory Law under The Representation of the People Act, 1950/1951 and PREAMBLE of the Constitution of India, WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a (SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC) and to secure all its citizens: JUSTICE, Social, Economic and Political; LIBERTY of thought , expression,belief, faith and worship; EQUALITY of status and of opportunity; and to promote among them all, FRATERNITY assuring the dignity of the individual and the ( unity and integrity of the Nation);. All Political Parties must be governed by Statutory Laws that there must be minimum qualifications to allot Political Party ticket to contest as M.P. or M.L.A. impeccable integrity, knowledge of the Constitutional, other laws for Law Makers whose Priority will be to enact Laws apartment from Governance that is majority Party forms the Government. Since first elections what lacked our Law Makers that is M.Ps.& M.L.As. has been lack of Intellectual Intelligentsia, zeal to serve the People selflessly, lack of Administrative knowledge, could not provide Good Governance, could not prevent corruption,Nepotism, favourtism,failed to enact welfare legislatures to Protect the People as per the constitution of India. Preamble of the Constitution of India socialist Economy should be implemented, Social Justice that is Justice, social, Economic, Political to be rendered to the People of India as guaranteed by the Constitution of India. Philosophy of the Constitution of India is Socialist Secular Democratic, Social Justice that is Justice, Social, Economic and Political to the rendered to the People of India as guaranteed by the constitution of India, to Equalize Economic Disparities between RICH & POOR. True Democracy is that elected Representatives that is Law Makers ( M.Ps. & M.L.As.)must enact welfare Legislations for the welfare of the People, according to the evolution in the society laws must be amended, new laws to be enacted so that Right so the People will be Protected. Elected Law Makers M.P. or M.L.A. to enact legislations and Provide Good Governance to see that the People will suffer. Each Political Party promises to implement election manifesto if it is elected to govern that must be implemented Central or State, election Manifesto of all Political Parties must be in accordance with the Constitution of India, Statutory Laws of India. Preamble is the golden goals set out are to be achieved by the Indian Polity the noble object of the Constitution of India. The objectives specified in the Preamble contain the basic structure of the Constitution of India and the Parliament does not have power under Article 368 of the Constitution of India to amend Preamble. Democracy will of the People is supreme and elected Public Representatives Law Makers M.Ps. & M.L.As. have to abide by the Constitution of India and Statutory Laws of India. Democratic form of the Government is majority M.Ps. Or M.L.As. elected Party/Parties the Government. True Democracy is that Political Parties allotted M.P. or M.L.A. tickets to intellectuals of intelligentsia without taking graft that is Moneyocrcy, Liquorocracy, Dineocracy and sexocracy and Political party contesting candidates without offering four grafts to the Party leaders, Workers, the People and Voter are elected that is the TRUE DEMOCRACY AND ELECTED LAW MAKERS M.Ps. & M.L.As. uphold Democracy, Rule of Law and Rule according to the constitution of India, Statutory Laws as per the WILL OF THE PEOPLE. WHICHEVER POLITICAL PARTY M.Ps. OR M.L.As. elected and the Opposition party must Protect the Rights of the People by expose the Misgovernance of the ruling Party that is the True Democracy.

To, The competent concerned, Sir/Madam All the elections conducted by Election Commission of India and subsequent constitution of the respective legislative bodies and consequent formation of the Governments at the centre and states and passing/making order and decisions on the issues of elections by the Judiciary are unconstitutional and illegal on the following grounds:- (1) Late Dr. Rajendra Prasad was not the President of India from 26th January 1950 to the first due election of the President after the general elections in the country. The Constitutional provisions relating to the office of the President and his election under Part V Chapter I Articles 52 to 62 came into force on the commencement of the Constitution of India i.e.,26th January,1950 but he continued till the first election of the President without any legal and constitutional basis. That is constitutionally wrong and illegal. (2)Late Jawahar Lal Nehru was not the Prime-Minister of India from 26th January 1950 to the first due election of Lok Sabha in April-May 1952. The constitutional provisions relating to constitution of the Lok Sabha Part V Chapter II came into force on the commencement of the constitution of India.The interim /provisional parliament from 26th January, 1950 to the first general election of the Lok Sabha was constitutionally wrong and illegal. (3) As the consequences of the above stated facts the Passing and enforcement of the two election laws namely the R.P.Act. 1950 and 1951 are constitutionally wrong and illegal and as such they have no mandate to be implemented as the constitutionally constituted Parliament was not there at that time. (4) The similar is the case with constitution of State Legislative bodies in the respective states and formation the respective Governments in the States during 26th January 1950 till the first constitutional legislative election in the state. (5) The Supreme Court decisions reported as Air 1959 SC 1318 para 12, Air 1972 SC 2284 para 12 and Air 1999 SC 1723 para 25 mandate that the candidate must be an elector in the constituency for M.P.(Lok Sabha directly elected) and Vidhan Sabha( directly elected) elections. But Election Commission of India despite being respondent party in 1972 judgement and having full knowledge and possession of the decisions having been produced by me is adamant not to implement the law laid down by the Apex Court and has been conducting unconstitutional and illegal elections permitting non elector in the constituency to contest elections. Thereby elections are totally against the constitutional judicial mandate of the country.It is illegally permitting the outsider to contest election of Lok Sabha in a state. The Meira Kumar being SC of Delhi has been getting benefit of reservation in different stated in the elections of the Lok Sabha which is totally against Article 330 of the Constitution of India. Even the Sonia Gandhi and Rahul Gandhi and similarly situated other members of the Lok Sabha are not elector in their respective constituencies and even outsider to the concerned states. (6) If the elections are illegal, subsequent constitution of the legislative bodies and the formation of the Government and decisions of the Judiciary are unconstitutional and illegal.
