Property on gpa with agreement to sell

(Querist) 08 March 2015 This query is : Resolved 
A property was purchased in 1996 from original allotee of industrial plot from Haryana Govt. The documents given by seller were original possession letter and conveyance deed from Haryana Govt. besides GPA in purchaser's family name, agreement to sell, receipt for payment, affidavit but no will. Now purchaser wishes to get the property transferred in his name but the whereabouts of the allotee are unknown and the department wants GPA to certify that allotee is alive and in case of his death NOC from legal heirs which again is not possible as the whereabouts of seller are not known. Someone suggested issuing a public notice declaring that sale has been carried out in 1996.

Please suggest some solution.

I think public notice is a good option..... Or you can also trace the allotted with the hell of RTI seeking whether he is alive or expired and all ....

In case you are finally unable to trace the Seller:
Option 1: Speak to the Department officials if a public notice will be sufficient to effect name transfer (as you have all other documents)
Option 2: If option 1 is negative a Court order declaring the Title to the property should be sufficient to effect name transfer. Please consult a local lawyer for filing a suit for Title declaration.

As suggested by expert Mr. Poojari, you may alternately file a declaration suit to declare title on the basis of documentary evidences in your possession.
