Non occupancy chargges in chs in mumbai

Can Non Occupancy charges be levied from a flat owner if he has locked his flat and does not stay in it, he has not rented it but keeps it vacant.

Refer the society bye laws / AGM resolution and any thing against Rules need to be challenged before the registrar of societies / legally.

According to Model Bye-Laws of Maharashtra, 2014, non-occupancy charges can not be levied if the flat is kept vacant and not rented to any one.

What do you actually mean from "non-occupancy charges" i.e., you want to know the charges levied by BMC or CHS?
BMC shall charge property tax whereas, CHS charges are to be decided and levied by members.
Consult a local lawyer with Bye-laws of the society.
