Entrance gate of our society

Dear Sirs, I am a member of Ishan A CHS Ltd, 547 Jame Jamshed Road, Matunga, Mumbai 400019. We have not received conveyance from our Builder. We have two entrance gates. Our gate is being kept half closen since few days. I being handicapped with multiple chronic health ailments and vision problem, staying alone, find it difficult to step down from the cab and walk down to the elevator. I have requested the watchmen of the other wing to keep the gate open, but they are not co operating. Please advice what to do..thanking you in advance- Ketan M ganatra

Watchman is not obliged to follow your request without the instructions of the management/builder. You may contact the builder.

Agreeing with Mr Jigyasu, I will add that you can give written notice to the society. If that fails then you can represent to the Registrar of societies and if that also fails then complaint to the Commissioner with Diabilities who has powers to summon your society as well as registrar.

On second though it is seen that above views expressed by me (tough touch and effective) will not fetch immediate result.

Each time you are stopped at the said gate you can dial 100 each time. Let Police come each date to society and summon Secretary to the gate each day. Since the gate is in the building plan you have a lawful right to proceed from that gate.

send written complaint to secretary of society to give necessary directions to watchman to open full gate so that u can come in easily.

Instead of opting for legal recourse it would be better to personally discuss the issue with management, especially the Secretary & President. I am sure they shall be considerate to direct the watchman as you desire.
Such circumstances are being faced/experienced in almost all CHS, even where I am President of a CGHS in Dwarka, New Delhi for the last about 6 years (2 terms x 3 years). I am sharing my personal experience.
