Court unwilling to record evidence

Guest (Querist) 17 June 2017 This query is : Resolved
Dear Sirs:
A dioctor lodged an FIR against me on false charges of robbery and hurt, I was arrested and sent to jail. Now the case has come to court for prosecution evidence.
The Magistrate refuses to record that portion of the evidence which exposes the conspiracy/recklessness of the police to frame me. The I.O. deposed that a certain police officer was overzealous to get ne arrested and send me to jail but the court refused to record it saying that this is "irrelevant" and has got no probative value.
Just like to know if the court is justified in doing so. Is there any way to get such evidence recorded?

What is the stand of your lawyer? Anyhow, Court cannot refuse to record any such evidence. Is it during examination-in-chief or cross examination?

Hello Venu Sir:
Actually lawyer is keeping silent.
My lawyer cross-examined the IO and he stated that due process of law was not followed at the time of arest due to interference of a senior police officer.
The court refused to record this stating that it is irrelevant and will not help the ciurt to come to any finding...
