NOC from society

My society in mumbai is not giving me the noc to sell my own flat unless i pay them 75000 as welfare fund in the name of society. I have already agreed to pay 25000 transfer charges but can't pay any more. I need the noc for the buyer to get his loan disbursed. Pls help me out with this issue

Has the society issued any such demand in writing?


If unethical and against bye laws, you can agitate.

File a complaint with societies registrar. If problem not solved you can move high court. Ex facie, it appears illegal.

Society cannot charge anything for the purpose of NOC if you have cleared all the dues of the society. You are freehold owner of your property then who is the society to demand such huge amount in the name of its welfare under the garb of NOC.

Immediately make a written complaint to the Registrar and if no action is initiated by it then agitate this issue in high court.

The society has no right to withhold "NO DUES CERTIFICATE" instead of "NOC" as the society has no concern with sale, purchase, rent, gift or transfer your flat in any manner whatsoever, even if society has sent you a written demand.

Lodge complaint before Registrar Cooperative Societies for illegal and unauthorised activity/demand of the Managing Committee and/or file a mandatory suit.
