Hi all
My seller now wants to cancel the deal
We had done registration of the flat and had paid him some advance and it was decided that once the full amount check will come from bank the seller will return the excess amounts but now he is refusing to return the amount and is asking to cancel the deal

You may show the agreement to sell and registration that you have mentioned to a very able counsel specializing in such/property/revenue/civil matters for a considered opinion.

Without examination of the transaction related papers/ registered sale deed, any opinion can not be expected to help you.

Better consult some local lawyer showing him documents or send the sanned copies of the documents to some expert of LCI to guide you appropriately.

come with the clear facts. Principally if either of the parties has backtracked from its role contained, the consequences contained in the agreement to sale itself shall prevail.
