R.K Nanda (Expert) 03 May 2015
no, impotent husband cannot prolong case in court as court will decide it on merits.
Devajyoti Barman (Expert) 03 May 2015
The merit of the case has no nexus with prolonging the case.
R.K Nanda (Expert) 03 May 2015
it is the backlog of cases in court which may prolong the case but impotent husband cannot delay case and court always decide case on merits.

@ thedon,
1. Is it your real name or adopted one to avoid being taken as "anonymous" ? How are you concerned with the query?
2. Why and what for the impotent husband want to continue the institution of marriage by prolonging the annulment (not divorce)case in the court?
Rajendra K Goyal (Expert) 04 May 2015
Husband can not prolong the case as a matter of right legally, procedural delay may drag the case for years.
thedon (Querist) 04 May 2015
can husband say ,he going under medical treatment and can tell result after 1 yr?
T. Kalaiselvan, Advocate (Expert) 06 May 2015
You have no query at all but want to capitalise on some issue(?), it is very clear that the husband being an impotent person cannot prolong the case without any reason, so what is your query?
If there was no conjugal relationship between them why did she not mention it in her petition, who filed the divorce petition?, also, if she wants to resign her job let she do it, what is the problem on that? Make yourself clear to what to clarify and then post the query.
